Terms and Conditions
For the Terms and Conditions of Sales, the "Company" will mean Kal Wine Source UK LTD (trading name “Wine Source”) and/or its subsidiaries. The "Customer" will mean any person, firm, company or body that places an order with the Company. By placing an order with the Company the Customer agrees to have read these terms and conditions and accepts and agrees to be bound by them
1. Orders
The Company reserves the right to accept or to reject a Customer order in the event that any of the products or services requested are unavailable or in the event of price discrepancies. In such a case, the company will notify its Customer by phone or email prior to the requested delivery date.
2. Prices
Unless the contrary is agreed, the Company quotes its prices per case or per bottle, exclusive of sales taxes and exclusive of delivery charges. The company reserve the right to change its prices in the case of a price discrepancy of an item or service. The Customer may choose if to agree and proceed with the corrected priced order, or alternatively, to cancel the order before the company dispatches the items. In such case, the Company shall proceed to refund the Customer of any advance payment(s).
3. Payment
Payment is due on order confirmation and before delivery. We do not store customer credit card details nor do we share customer financial details with any third parties.
4. Title and Risk
All risks in the products shall pass to the Customer upon delivery/collection of the goods but the Company shall retain the title of the goods until full payment has been received.
5. Delivery
Wine Source offer free delivery to London area for orders over £250. For orders under £250, we charge £18 per address. Orders are dispatched on a next-day service where possible, but please note that deliveries can take up to 3 working days to arrive. Orders placed after 2 pm or on a weekend/bank holiday are processed on the next working day.
7. Force Majeure
The Company shall not be liable for any delay or failure in its performance caused by or resulting from acts of God, fire, flood, accident, riot, war, government intervention, embargoes, strikes, labour difficulties, equipment failures, or any other causes beyond the reasonable control of the Company. The Company reserves the right to accept or to reject a Customer order in the event that any of the products or services requested are unavailable or in the event of price discrepancies. In such a case, the company will notify its Customer by phone or email prior to the requested delivery date and organise the refund based on the original cost price.
8. Return and Faulty Bottles
Please get in touch with us as soon as possible on +44 203 405 5748 or via info@winespurcetsore.com if there are any discrepancies or problems with your order.. We're happy to take back any bottles that are still in perfect condition up to 2 days from order reception. Please get in touch with us to start the returns process. All charges (minus the original delivery cost) will be refunded upon our receipt of the goods in their original condition of sale. The cost of returning the order is at your expense. Risk remains with the buyer until the wines are re-delivered to us.
If you suspect a wine is out of condition, reseal the bottle and contact us ASAP. We may need to arrange the collection of any suspected out-of-condition bottles for analysis. Faulty wines will be refunded, credited or replaced, subject to availability. Please note that we can only offer refunds, credit or replacements up to six months from the original purchase date, provided the bottles have been properly stored.
9. Limitation of liability
The Company shall not be liable to the Customer or any other person, whether in tort, contract, statute or otherwise (including without limitation for negligence, breach of contract, defamation, or intellectual property right infringement) for:
a. Any direct loss for which the Company cannot reasonably be held responsible.
b. Any consequential or indirect, incidental, special or exemplary loss (including without limitation loss of revenue or profits, goodwill, use, data or other intangible losses).
In any and all cases, the Company liability and indemnification will be limited to the value of the order placed by the Customer.
10. Law
All our contracts are made under the Company's country of residence Law and are subject to the exclusive jurisdiction of that country binding Courts.
11. Copyright and Trademarks
All rights reserved. All content (texts, trademarks, illustrations, photos, graphics, files, designs, arrangements etc.) on this website of Wine Source Group are protected by copyright and other protective laws. The contents of this website are to be used only in accordance with Internet regulations.
12. Privacy
Wine Source Group respects your privacy. We will not sell, share or pass on your details to any third party. We will ensure encryption of all your data. We do not store any credit card details. When you sign up on our website for our digital newsletter and marketing communications to receive information, news and offers we collect your email address. Legal basis for processing: your consent (Article 6(1)(a) of the General Data Protection Regulation). Consent: you give your consent to us sending you our digital newsletter and marketing communications by signing up to receive it using the steps described above. Information you submit to subscribe for our newsletter will be stored outside the European Economic Area on MailChimp’s servers in the United States of America. We will send you marketing communications in relation to our goods and services only if you opt in to receive them. You can unsubscribe from our communications at any time by contacting marketing@wine-source.com
